Proprietary Software License Agreement

METEO P4 Firmware · Version 2.1
PROPRIETARY SOFTWARE LICENSE AGREEMENT
for METEO P4 Firmware

Version: 2.1
Rightsholder: Sergii Stelmakhovych / SRG BlackCore
Year: 2026

1. Definitions
For the purposes of this License:

"Firmware" means the METEO P4 software and all related components supplied for the device,
including executable code, interface design, screen layouts, graphics, logic, configuration
flows, built-in scenarios, service functions, data structures, and accompanying materials,
except for third-party components governed by their own license terms.

"Device" means the hardware unit for which the Firmware is supplied, installed, or authorized.

"User" means the individual or legal entity that lawfully possesses or operates the Device.

2. Ownership and Reservation of Rights
The Firmware is proprietary and is protected by copyright and other applicable intellectual
property laws.

All rights, title, and interest in and to the Firmware, including all modifications, updates,
derivative elements, visual design, structure, and embedded logic, are and shall remain the
exclusive property of Sergii Stelmakhovych / SRG BlackCore, except for third-party components
expressly identified as belonging to their respective owners.

The Firmware is licensed, not sold. No ownership right is transferred to the User.

No source code rights are granted under this License.

The supply of the Device or Firmware shall not constitute a transfer of ownership of
intellectual property rights or exhaustion of the Rightsholder's exclusive rights except
to the minimum extent required by mandatory law.

Nothing in this License shall be interpreted as placing the Firmware or any proprietary
portion thereof into the public domain or under any open-source license.

Any rights not expressly granted under this License are reserved by the Rightsholder.

3. Limited License Grant
Subject to compliance with this License, the Rightsholder grants the User a limited,
revocable, non-exclusive, non-transferable, non-sublicensable license to use the Firmware
solely:
- on the Device for which the Firmware is supplied or authorized;
- for the intended operational purpose of that Device;
- in object code form only;
- for internal use by the User in connection with the Device.

4. Permitted Use
The User may:
- operate the Firmware on the authorized Device;
- use the configuration and service features made available through the normal user interface;
- create one archival backup copy solely where strictly necessary for recovery,
  restoration, or servicing of the same authorized Device.

5. Restrictions
Except to the limited extent that such restriction is prohibited by mandatory applicable law,
the User shall not, and shall not permit any third party to:
- copy, reproduce, republish, distribute, disclose, transmit, lease, rent, sell, assign,
  sublicense, or otherwise transfer the Firmware or any part of it;
- install, port, clone, adapt, or use the Firmware on any device, board, emulator, virtual
  environment, or product other than the authorized Device;
- modify, translate, patch, alter, customize, merge, or create derivative works based on the
  Firmware;
- reverse engineer, decompile, disassemble, decode, extract, inspect, or otherwise attempt to
  derive source code, design logic, protocols, structure, or non-public implementation details
  of the Firmware;
- bypass, emulate, forge, manipulate, disable, interfere with, or circumvent any activation,
  authentication, licensing, cryptographic, telemetry, pairing, hardware-binding, integrity
  verification, or protection mechanism implemented within or in connection with the Firmware;
- bypass, disable, remove, or interfere with any technical restrictions, access controls,
  branding, notices, telemetry, service limitations, or protection mechanisms included in the
  Firmware;
- remove, obscure, or alter any copyright notice, ownership notice, version identifier,
  trademark, logo, attribution, or license reference;
- publish, disclose, distribute, or make available any benchmark results, performance analysis,
  reverse engineering findings, protocol analysis, security analysis, or comparative evaluation
  relating to the Firmware without prior written consent of the Rightsholder;
- use the Firmware, its interface, graphics, structure, or logic as a basis for any competing
  product or derivative commercial solution;
- use the Firmware as part of any commercial hosting, managed service, shared processing
  environment, service bureau operation, or third-party commercial platform without prior
  written authorization from the Rightsholder;
- separate the Firmware from the Device delivery context for standalone exploitation,
  commercialization, or redistribution.

6. Attribution Requirement for Authorized Copies
Where copying, redistribution, publication, or transfer of the Firmware is expressly authorized
in advance and in writing by the Rightsholder, each authorized copy or redistributed instance
must include a clear and visible attribution link to the author using the official SRG BlackCore
logo, branding, or logo-based author reference format approved by the Rightsholder.

Such attribution must be visibly presented:
- on the device screen or user interface where the Firmware is identified, presented, or made
  available to the end user;
- in accompanying documentation, manuals, service materials, packaging inserts, or setup guides
  distributed with the Firmware or the authorized Device;
- in any public publication, announcement, offer, showcase, listing, repost, or other public
  communication relating to the copied, redistributed, or transferred Firmware.

The attribution must remain clear, legible, and reasonably prominent, and must not be removed,
obscured, hidden, minimized beyond reasonable visibility, detached from the logo, or replaced
with alternative branding without prior written consent of the Rightsholder.

Any authorized copy, redistribution, or transfer made without such visible attribution link and
official logo-based author reference shall constitute a material breach of this License and may
result in termination of any granted authorization at the discretion of the Rightsholder.

6A. Trademark and Branding Protection
No right, license, permission, or authorization is granted under this License to use any
trademark, trade name, commercial designation, product name, logo, brand identifier, visual
identity element, or other branding of the Rightsholder, except where such use is expressly
authorized in writing.

Any permitted use of branding elements must comply with the branding guidelines, visual
standards, and attribution requirements established by the Rightsholder.

7. No Implied Rights
No right or license is granted by implication, estoppel, exhaustion, or otherwise, except as
expressly stated in this License.

8. Updates and Support
The Rightsholder may, at its sole discretion, provide updates, upgrades, fixes, patches, or
new versions of the Firmware.

Nothing in this License shall be interpreted as creating any obligation to provide maintenance,
technical support, updates, or over-the-air update capability.

The absence of updates, including OTA updates, does not constitute a defect, failure of
performance, or breach of obligation unless expressly agreed in writing by the Rightsholder.

9. Third-Party Components
The Firmware may include third-party software components subject to separate license terms.
Such components remain the property of their respective rightsholders.

This License applies only to the proprietary portions of the Firmware. For third-party
components, the applicable third-party license terms shall govern that component to the extent
required by law or by the relevant license.

10. Compliance and Termination
This License shall terminate automatically and immediately if the User breaches any term of
this License.

Upon termination, the User must immediately cease all use of the Firmware and destroy or remove
all copies under its control, except where retention is strictly required by applicable law or
documented service obligations.

Termination shall not limit any other rights or remedies available to the Rightsholder.

10A. Injunctive Relief
The User acknowledges that any unauthorized copying, redistribution, modification, reverse
engineering, disclosure, circumvention, or misuse of the Firmware may cause irreparable harm
to the Rightsholder for which monetary damages alone may be insufficient.

Accordingly, the Rightsholder shall be entitled to seek injunctive relief, equitable remedies,
interim measures, or other legal protection in addition to any other remedies available under
applicable law.

10B. Compliance Verification and Evidence
The User acknowledges that firmware identifiers, activation records, cryptographic signatures,
telemetry data, device pairing records, service logs, and related technical information may be
used by the Rightsholder as evidence of license compliance or violation, to the extent
permitted by applicable law.

11. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE FIRMWARE IS PROVIDED "AS IS" AND
"AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED,
STATUTORY, OR OTHERWISE.

THE RIGHTSHOLDER EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT,
ACCURACY, SECURITY, OR UNINTERRUPTED OPERATION.

THE RIGHTSHOLDER DOES NOT WARRANT THAT THE FIRMWARE WILL OPERATE WITHOUT INTERRUPTION OR ERROR,
OR THAT IT WILL MEET ANY SPECIFIC REQUIREMENTS OF THE USER.

12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE RIGHTSHOLDER BE LIABLE
FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES,
INCLUDING WITHOUT LIMITATION LOSS OF DATA, LOSS OF REVENUE, LOSS OF PROFIT, BUSINESS
INTERRUPTION, DOWNTIME, LOSS OF USE, EQUIPMENT DAMAGE, OR COST OF SUBSTITUTE GOODS OR SERVICES,
ARISING OUT OF OR RELATING TO THE FIRMWARE OR THIS LICENSE, EVEN IF ADVISED OF THE POSSIBILITY
OF SUCH DAMAGES.

THE TOTAL AGGREGATE LIABILITY OF THE RIGHTSHOLDER ARISING OUT OF OR RELATING TO THE FIRMWARE
SHALL NOT EXCEED THE AMOUNT, IF ANY, ACTUALLY PAID FOR THE SPECIFIC DEVICE TO WHICH THE
FIRMWARE WAS SUPPLIED.

13. Export, Transfer, and Assignment
The User may not assign or transfer this License or any rights under it without prior written
consent of the Rightsholder.

Any attempted assignment, delegation, or transfer in violation of this clause shall be null
and void.

14. Governing Law and Jurisdiction
This License shall be governed by and construed in accordance with the laws of Poland,
without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to this License or the Firmware
shall be subject to the exclusive jurisdiction of the competent courts of Poland, unless
otherwise agreed in writing by the Rightsholder.

15. Entire Agreement
This License constitutes the entire agreement with respect to the Firmware unless superseded
in whole or in part by a separate written agreement signed by the Rightsholder.

If any provision of this License is held invalid, illegal, or unenforceable, such provision
shall be modified and enforced to the minimum extent necessary to make it valid and enforceable,
while preserving its original intent as closely as possible.

The remaining provisions shall remain in full force and effect.
